Warranties

1. Legal warranties

Regardless of any commercial warranty granted by Répétition, the buyer benefits from the legal warranties provided by law:

a) Legal warranty of conformity (articles L.217-3 to L.217-20 of the Consumer Code)

  • The seller is obliged to deliver a good that conforms to the contract and is liable for any conformity defects existing at the time of delivery.
  • The buyer has a period oftwo (2) yearsfrom the delivery of the good to take action.
  • The buyer can choose between repair or replacement of the good, subject to the cost conditions provided by article L.217-12 of the Consumer Code.
  • The buyer is exempt from providing proof of the existence of the conformity defect during thetwenty-four (24) monthsfollowing the delivery of the good.

b) Legal warranty against hidden defects (articles 1641 to 1649 of the Civil Code)

  • The seller is liable for the warranty due to hidden defects of the sold item that render it unfit for the intended use, or that diminish this use to such an extent that the buyer would not have purchased it, or would have paid a lower price, had they known.
  • The buyer has a period oftwo (2) years from the discovery of the defectto take action.
  • In the case of a hidden defect, the buyer can choose between rescinding the sale or a reduction in the sale price (article 1644 of the Civil Code).

 

Clause – Costs in case of warranty exclusion

Product examination and exclusions

When a customer requests the application of the legal warranty of conformity or the warranty against hidden defects, Répétition will carry out an examination of the product.

If, at the end of this examination, it appears that the defect claimed does indeed fall under one of these legal warranties, Répétition will fully cover the costs related to the implementation of the warranty (parts, labour, round-trip transport).

On the other hand, if the defect found does not fall within the scope of the legal warranties or the commercial warranty of Répétition (notably in cases of damage resulting from an accident, a fall, a shock, inappropriate use, user negligence, or normal wear and tear), the customer will be informed without delay.

In this case, the watch will be returned to the customer. The transport costs and, if applicable, the costs of expertise will remain the sole responsibility of the customer.

Répétition may, if the customer wishes, provide a repair estimate as part of its after-sales service.
